These Terms of Service ("Terms") govern your access to and use of coolhill.pro, our online store, products, content, features, and related services.

By accessing our website or placing an order, you agree to these Terms.

Nothing in these Terms excludes or limits any right or protection that cannot lawfully be excluded.

1. About CoolHill

CoolHill operates an online store offering portable cooling products, including handheld cooling fans, desktop fans, bundles, and related accessories.

Our online store is powered by Shopify.

2. Eligibility and Lawful Use

You may use our website only for lawful purposes.

You must not use the website for fraud or deceptive activity, interfere with website security, introduce malicious code, impersonate another person, violate intellectual-property rights, misuse promotions/payment systems/returns/chargebacks, or use our products in an unlawful or intentionally unsafe manner.

We may restrict or refuse access where reasonably necessary to protect CoolHill, customers, payment providers, or our systems.

3. Product Information

We make reasonable efforts to present product information accurately.

Minor differences may occur because of product revisions, manufacturing tolerances, lighting, photography, screen settings, packaging changes, colour reproduction, or supplier updates.

Such differences are not automatically defects where they do not materially change the advertised product or its core functionality.

Nothing in this section permits CoolHill to materially misdescribe a product or avoid mandatory consumer rights.

4. Cooling and Performance Information

Cooling and airflow products can perform differently depending on how and where they are used.

Actual experience may vary based on factors including ambient temperature, humidity, speed level, cooling mode, distance and positioning, battery charge, airflow obstruction, charging condition, and usage duration.

References to airflow, battery capacity, cooling components, adjustment ranges, speed levels, or other specifications describe the product configuration or advertised capability and do not guarantee that every user will experience an identical subjective cooling sensation in every environment.

Nothing in this section reduces any right where the product materially fails to conform to an advertised specification.

5. Battery and Runtime

Battery-powered products may have different operating times depending on selected speed, cooling mode, ambient temperature, charging method, battery age, frequency of use, and product condition.

Battery runtime naturally changes over time and with use.

Normal variation or gradual battery aging is not automatically a manufacturing defect, subject to applicable consumer law.

6. Safe Product Use

Customers are responsible for using CoolHill products according to product instructions and ordinary safety precautions.

You should keep fan openings clear; keep hair, loose clothing, fingers, and foreign objects away from moving fan components; use compatible charging equipment; avoid unauthorized opening or modification; avoid liquid exposure unless expressly permitted; and stop using a product if it shows signs of serious overheating, physical damage, or another unsafe condition.

CoolHill is not responsible for customer-caused damage or loss resulting from improper use to the extent permitted by law.

7. Orders

Submitting an order is an offer to purchase.

An automated order confirmation does not necessarily mean that CoolHill must accept an order in every circumstance.

We may refuse, cancel, limit, or review an order where reasonably necessary because of suspected fraud, unauthorized payment, pricing or listing errors, stock errors, duplicate orders, shipping restrictions, incorrect customer information, technical errors, abuse of promotions, or payment-provider/risk-review requirements.

If CoolHill cancels an accepted order after payment and no lawful amount remains payable, the applicable amount will be refunded.

8. Customer Information

You are responsible for ensuring that information supplied at checkout is accurate and complete, including your name, email address, phone number, billing information, shipping address, country, and postal or ZIP code.

CoolHill is not responsible for avoidable delay or additional costs caused by incorrect customer-provided information, except where applicable law provides otherwise.

9. Prices and Payment

Prices are displayed on the website and confirmed during checkout.

Taxes, duties, delivery charges, or other permitted charges may be shown separately.

CoolHill may correct genuine pricing, typographical, or technical errors.

Where an obvious pricing error occurs, CoolHill may cancel the affected order and refund the amount paid, subject to applicable law.

Payments may be processed by Shopify or third-party payment providers.

10. Promotions, Bundles, and Free Items

CoolHill may offer promotional prices, limited-time offers, bundles, discounted packages, complimentary products, free gifts, and free or discounted shipping.

Promotions may be subject to additional stated conditions.

Promotional wording does not remove statutory rights.

Where an entire bundle is returned, all included items may need to be returned together in accordance with the Return & Refund Policy.

11. 30-Day Guarantee

Where the website refers to a 30-day guarantee, the meaning and limitations of that guarantee are set out in the CoolHill Return & Refund Policy.

Unless expressly stated otherwise, it is not intended to create an unrestricted 30-day change-of-mind trial beyond any mandatory legal right that applies.

12. Processing and Shipping

Orders are processed and delivered in accordance with our Shipping Policy.

Processing and delivery estimates are not guarantees unless CoolHill expressly states that a specific date is guaranteed.

Courier delays, customs procedures, weather, government action, transportation disruption, peak periods, or other events outside our reasonable control may affect delivery.

Mandatory consumer delivery rights remain unaffected.

13. Order Changes and Cancellations

Customers should review their order carefully before submitting payment.

Once an order has entered processing, fulfilment, or shipping, CoolHill generally cannot guarantee cancellation or modification.

Any mandatory statutory cancellation or withdrawal right remains unaffected.

14. Returns and Refunds

Returns, cancellations, defect claims, replacements, and refunds are handled according to our Return & Refund Policy, which forms part of these Terms.

Mandatory legal rights remain unaffected.

15. Third-Party Services

Our website and checkout may depend on third parties including Shopify, payment providers, shipping companies, analytics services, marketing providers, and customer-support tools.

CoolHill does not control third-party systems and cannot guarantee that they will remain continuously available or unchanged.

Your use of third-party services may also be governed by their own terms and privacy policies.

16. Website Availability

We aim to maintain a reliable website but do not guarantee uninterrupted or error-free availability.

We may temporarily suspend, modify, or restrict website access for maintenance, security, technical problems, updates, or events outside our reasonable control.

17. Intellectual Property

Unless otherwise stated, the CoolHill name, branding, website design, original text, graphics, product presentation, photographs, videos, logos, and other protected content are owned by or licensed to CoolHill.

You may not reproduce, republish, distribute, commercially exploit, or misuse protected content without authorization except where permitted by law.

18. Customer Reviews and Submitted Content

If you voluntarily submit reviews, photographs, videos, testimonials, or other material for publication, you represent that you have the right to submit it, it does not unlawfully infringe another person's rights, and it is not knowingly false, fraudulent, or misleading.

Any separate marketing-use permission requested by CoolHill will be governed by the terms of that permission and applicable law.

19. Fraud, Abuse, and Chargebacks

CoolHill may retain and provide relevant transaction evidence when investigating suspected fraud or responding to a payment dispute.

Evidence may include order information, payment information, shipping and tracking records, delivery confirmation, customer communications, return records, product evidence, and device or fraud-risk information where lawfully collected.

Customers retain all lawful rights to dispute unauthorized or improper transactions.

Knowingly false claims or fraudulent disputes may be challenged and, where appropriate and lawful, reported.

20. Disclaimers

To the maximum extent permitted by law, CoolHill does not guarantee that the website will always be uninterrupted, every user's subjective cooling experience will be identical, battery runtime will remain identical under all modes and conditions, minor cosmetic aspects will exactly match every website photograph, or delivery estimates will never be affected by external events.

Nothing in these Terms excludes any express guarantee made by CoolHill or any legal warranty that cannot be excluded.

21. Limitation of Liability

To the maximum extent permitted by applicable law, CoolHill is not liable for indirect, incidental, special, or consequential loss that was not reasonably foreseeable or that results from matters outside our reasonable control.

Where legally permitted, CoolHill is not responsible for loss caused by customer misuse, unauthorized product modification, improper charging, failure to follow instructions, third-party service failures, or customer-provided incorrect shipping information.

Nothing in these Terms limits liability where doing so would be unlawful.

22. Events Outside Our Reasonable Control

CoolHill is not responsible for failure or delay caused by events outside our reasonable control, including courier disruption, customs delay, severe weather, natural disasters, war or civil disturbance, government restrictions, network outages, labour disputes, supply-chain disruption, or third-party service outages.

This provision does not remove any mandatory legal remedy arising from a legally significant delay or failure.

23. Governing Law and Mandatory Consumer Protections

To the extent permitted by applicable law, these Terms are governed by the law applicable to the CoolHill business operating the store.

If CoolHill is operated from the United Arab Emirates, UAE law may apply, subject to any mandatory consumer-protection or jurisdiction rule applicable to the customer.

Nothing in these Terms deprives a consumer of a protection that applicable law does not permit the consumer to waive.

24. Severability

If any provision is invalid, unlawful, or unenforceable, it will be limited or removed only to the extent necessary.

The remaining provisions will continue in effect.

25. Changes to These Terms

We may update these Terms prospectively to reflect changes in products, services, technology, business practices, or applicable law.

The updated version will be published with a revised "Last Updated" date.

We will not retroactively remove rights already acquired where applicable law prevents us from doing so.
